Welcome to Dabuwawa (“Dabuwawa”, “we”, “us”, “our”). We operate this website and store, including all related information, content, features, tools, products, and services (the “Services”), to provide you with a curated shopping experience. The Services are powered by Shopify.
These Terms of Service (the “Terms”) together with any policies referenced herein describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
SECTION 1 – ACCESS & ACCOUNT
You represent that you are at least the age of majority in your place of residence, and you consent to the use of the Services by any minor dependents on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, shipping). You warrant that all information you provide is correct, current, and complete and that you have the rights required to provide it.
You are solely responsible for safeguarding your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 – OUR PRODUCTS
We aim to display products accurately; however, colors and appearance can vary by device and settings. We do not warrant that any product’s appearance or quality will meet your expectations. Product descriptions, pricing, and availability may change at any time without notice. We may limit quantities to any person, region, or jurisdiction.
SECTION 3 – ORDERS
By placing an order, you make an offer to purchase. We may accept or decline any order at our discretion. An order is accepted when we confirm acceptance and process your payment. Review your order carefully; we may be unable to cancel after acceptance. If we decline, change, or cancel an order, we will attempt to notify you using the contact details provided at checkout.
Purchases are subject to our Returns & Refunds Policy. You represent that your purchases are for personal/household use and not for resale or export.
SECTION 4 – PRICES, TAXES & BILLING
Prices, discounts, and promotions may change without notice. The price at checkout is the price in effect and will be shown in your confirmation email. Unless expressly stated, prices exclude shipping and handling.
Region-specific pricing: In certain markets (e.g., UK/EU), consumer prices may be shown VAT-included. Where required by law (e.g., US state sales tax), applicable taxes are calculated and shown at checkout before payment.
You agree to provide current, complete, and accurate purchase and payment information and to promptly update your details (including card info and email) so we can complete your transactions and contact you as needed. You warrant that you are authorized to use the selected payment method.
SECTION 5 – CROSS-BORDER DUTIES & DDP
We strive to provide a “no-surprises” experience for international customers:

DDP (Delivered Duty Paid): For major destinations (including UK/EU/US/CA), we generally prepay import duties & taxes so you are not charged on delivery. Local legal requirements may still apply (e.g., UK VAT at point of sale for low-value consignments; EU IOSS VAT for qualifying orders).

Display: UK/EU prices are typically VAT-included. For other markets, any applicable taxes/duties we prepay are reflected in the total you see before paying.

Exceptions: Some addresses, products, or carriers may have restrictions or require alternative handling; we will communicate if applicable.
SECTION 6 – SHIPPING & DELIVERY
Delivery estimates shown at checkout are provided by carriers and are not guaranteed. Processing time (typically 1–2 business days) is in addition to transit time. We are not responsible for delays outside our control (e.g., carrier issues, weather, customs processing).
Risk of loss & title: Unless mandatory consumer law provides otherwise in your country, risk of loss passes upon delivery to your shipping address. If you appoint your own carrier, risk passes when we hand off goods to your carrier.
SECTION 7 – RETURNS & REFUNDS
Our 90-day return window and applicable regional rights (e.g., EU/UK cooling-off periods) are described in our Returns & Refunds Policy. Nothing in these Terms limits your statutory rights.
SECTION 8 – INTELLECTUAL PROPERTY
The Services (including trademarks, brands, text, images, graphics, video, audio, and their selection/arrangement) are owned by Dabuwawa or its licensors and protected by applicable IP laws. You may use the Services for personal, non-commercial purposes only. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from the Services without prior written consent. All rights not expressly granted are reserved.
Dabuwawa trademarks, names, logos, product names, designs, and slogans are our property or our licensors’. Shopify’s names and marks are trademarks of Shopify. Other names/logos are the property of their respective owners.
SECTION 9 – OPTIONAL TOOLS
We may offer access to third-party tools “as-is” and “as-available” without warranties or endorsements. Your use is at your own discretion and risk and subject to the provider’s terms. Future features may also be offered and are subject to these Terms.
SECTION 10 – THIRD-PARTY LINKS
The Services may contain third-party materials or links. We are not responsible for examining or evaluating such content or websites and we disclaim liability for your use of them. Review third-party terms and policies before engaging in any transaction.
SECTION 11 – RELATIONSHIP WITH SHOPIFY
The Services are powered by Shopify. However, your purchases are made directly with Dabuwawa. Shopify is not responsible for your sales transactions with us. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Dabuwawa.
SECTION 12 – PRIVACY
Personal information collected through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, certain information is processed by Shopify and its service providers; see Shopify’s privacy documentation for details. By using the Services, you acknowledge these practices.
SECTION 13 – FEEDBACK
If you submit reviews, comments, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any lawful purpose. You warrant you own the Feedback or have rights to grant this license; that any incentives are disclosed; and that your Feedback complies with these Terms. We may monitor, edit, or remove content we deem objectionable or unlawful.

Occasionally the Services may contain errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct or update information or cancel orders if any information is inaccurate at any time without prior notice.
SECTION 15 – PROHIBITED USES
You may use the Services only for lawful purposes. You will not: violate laws; infringe IP rights; harass, abuse, or harm others; transmit false/misleading information; upload malware; send spam; scrape or crawl; collect personal data without consent; interfere with security features; impersonate others; or otherwise engage in conduct we deem harmful. We may suspend or terminate access for violations.
SECTION 16 – TERMINATION
We may terminate or suspend the Services (or your access) at any time in our discretion. You remain liable for amounts due up to the termination date. Sections that by nature survive termination (e.g., IP, Feedback, Disclaimers, Liability limits, Indemnification, Severability, Governing Law) will continue to apply.
SECTION 17 – DISCLAIMER OF WARRANTIES
Except as expressly stated by Dabuwawa, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow limitations on implied warranties; these limitations may not apply to you.
SECTION 18 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no event will Dabuwawa or our officers, employees, affiliates, agents, contractors, service providers, licensors—or Shopify and its affiliates—be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, savings, data, or replacement costs arising from or related to your use of the Services or any products, even if advised of the possibility. Some jurisdictions do not allow certain limitations; portions of this section may not apply to you.
SECTION 19 – INDEMNIFICATION
You agree to indemnify and hold harmless Dabuwawa, Shopify, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law or third-party rights, or misuse of the Services.
SECTION 20 – SEVERABILITY
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will continue in full force and effect.
SECTION 21 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision is not a waiver of such right or provision. These Terms and any policies posted on the site constitute the entire agreement between you and us and supersede prior or contemporaneous communications.
SECTION 22 – ASSIGNMENT
You may not assign, transfer, or delegate these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.
SECTION 23 – GOVERNING LAW
These Terms and any separate agreements under which we provide Services are governed by the laws and courts of the jurisdiction where Dabuwawa is headquartered, without regard to conflict-of-law rules. You consent to venue and personal jurisdiction in such courts.
SECTION 24 – CONSUMER RIGHTS
Nothing in these Terms is intended to limit mandatory consumer rights under applicable law (e.g., EU/UK cooling-off rights). If a conflict arises between these Terms and non-waivable consumer law in your country, that law will prevail for the affected consumer.
